1. THE PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACT TERMS:


(hereinafter also the General Terms and Conditions or GTC)


 


The party of the first part, the supplier of the reservations, PRESTIGE HOTELS(hereinafter also the provider),customer service telephone number 972.252.100, and email prestigewelcome@prestigehotels.com, as owner of the website www.prestigehotels.com, presents the contractual document that will govern the contracting of room reservations through the aforementioned website. 


The party of the second part, the User–Customer (hereinafter the user), who realise the reservation, being responsible for the veracity of the personal data given to the provider. The user can be registered on the website by a user and password.


 


BOTH PARTIES ACCEPT this document, which entails the user:



  1. Has read and understood the provisions set out herein.

  2. Is of legal age and has sufficient capacity to enter into contracts.

  3. Assumes all of the obligations set forth herein.

  4. Has read and accepts these general terms and conditions of purchase from the moment they realize any reservation.


This document may be printed out and kept by users. 


The provider makes the following email address, prestigewelcome@prestigehotels.com, available to users for any questions that may arise about these conditions.


These conditions will be valid for an indefinite period and will be applicable to all contracts executed through the provider’s website, www.prestigehotels.com.


The provider reserves the right to unilaterally modify these General Terms and Conditions, without affecting the reservations acquired prior to the modifications, in order to improve the services offered. In any case, these General Terms and Conditions must be consulted before make any reservation.


We recommend keeping a copy of the data contained in the reservation. PRESTIGE HOTELS is not liable for any loss of data or files, or for any damage resulting from the user’s failure to back up the data contained in the reservation.


The civil liability of PRESTIGE HOTELS for the services supplied is limited to the value of the same. The user waives the right to hold PRESTIGE HOTELS liable for any item in the event of dissatisfaction with the services purchased on the website www.prestigehotels.com, as well as possible malfunctions, slowness of access, or errors in accessing the website, including loss of data or any other type of information that could exist on the computer or network of the user accessing the website www.prestigehotels.com.


PRESTIGE HOTELS put to your disposition the reservation of rooms in the Prestige hotels on the internet via its website, by telephone or email.


 


2. PURPOSE OF THE CONTRACT:


2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of lodging reservation of the selected room, for a limit time in exchange of a determinate price and public exposed in this website. The extra service of pet (dog) must be contracted at the moment of realise the reservation. The other extra services can be indicated in the observations and be contracted, under availability, at the arrive at hotel. The user accepts these conditions during the online contracting process by ticking the corresponding box. These GTC will apply from the day that reservation is done.


2.2 Territory of application: The www.prestigehotels.com online store is available throughout the world.


2.3 Capacity to contract: In order to make a reservation, you must be of legal age and have the capacity to enter into contracts. 


2.4 Customer acceptance: The validation of a reservation through the website www.prestigehotels.com is carried out by email and implies the automatic acceptance of the GTC. These conditions are available on the websitewww.prestigehotels.com or, if desired, we can make them available to you by email.


2.5. Modification of the General Terms and Conditions: PRESTIGE HOTELS reserves the right to make changes and/or modifications to these GTC. We advise our customers to review them regularly. If these changes or modifications are made after the reservation has been done, the conditions in force on the date in which the reservation was placed will apply.


 


3. INFORMATION PROVIDED ON THE WEBSITE www.prestigehotels.com:


3.1 Publication of prices: The prices of the rooms are those shown for each one in the information section on our website, www.prestigehotels.com


There are modalities of reservation that offers discounts or benefits for the cancellation.


The price of the extra service pet (dog) is the show at the moment of realise the reservation. The price of the rest of the extra services, will be informed at the moment of the presential contracting. The details of the types of cancellation are exposed in the section information of each room and also in the section 8 of this conditions.



            3.2 Room information: The information that appears in our advertising, brochures, in other written material, on our website, or provided to you constitutes an invitation to make a purchase. The contents ofwww.prestigehotels.com are constantly being renewed and updated to offer our customers the most comprehensive and detailed information possible. All the contractual information on www.prestigehotels.com is shown in Spanish, Catalan, English and French, and communication with customers and users, as well as contract formalisation, will be in any of these languages.


 


3.3 Availability of room(s): The rooms are published considering the requirements that the user indicated at the time of make the search. 


 


3.4 Reservations 24 hours a day, every day of the year: The hotel is open to the public for season. The opening period of each hotel are available here. The receiving hours for reservations realised when the hotel is open through website is twenty-four (24) hours a day, three hundred and sixty-five (365) days a year. Once the reservation is done, you will receive a confirmation email when the provider has received and confirm the payment of the reservation.


The reception time of the hotels to attend reservations through email or phone is 9 to 18h Monday to Friday. In July and August also Saturdays and Sundays 9 to 14h.


 


3.5 Fraud: If PRESTIGE HOTELS suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.


 


4. PURCHASING PROCEDURE:

The user to make the reservation can:


-        register on the website by creating a user account. To do this, the user must freely and voluntarily provide the personal data requested.


The user will select a username and a password, committing themselves to make diligent use of these and to not disclose them to third parties, as well as to notify the provider about any loss or theft of the same or possible access by an unauthorised third party, in such a way that the provider will proceed to immediate blocking.


The user cannot choose a username that includes words whose purpose is to confuse others by identifying themselves as representing the provider; expressions that are abusive or insulting; and, in general, expressions that are unlawful or that contravene the demands of morality and good manners.


-        Or realise the reservation as a guest and not be registered at the website by a user account. You will only be asked for the data that is essential for processing your reservation.


In accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will proceed using the following steps:



  1. Indicate the dates and destiny in the search to find the rooms available and make click in “search”.

  2. Following your indications will appear the available rooms. Once you find the room that you are looking for, click “select”.

  3. In this screen you can change the conditions. Once is selected, click in “reserve”.

  4. Once the reserve/s is selected, you must click next, and will appear the extra services that you want to reserve and once this step is finish you can click in “reserve” to realize the reservation. When you click this option will appear the confirmation of the purchase (summary of the reservations realized and extra if it’s the case, your data and the payment method selected). 

  5. You will be asked to provide personal data in order to place your order and for the subsequent delivery. The user’s consent to save their data and if you give your consent, your data will be saved and you will be sent product information, if you don’t allow it, your data will only be kept making the reservation. You can register if you want. You should review the spam and junk mail controls in your email inbox and always verify that the contact information you have provided is correct.

  6. Once you fill your data, will appear to total price of the reservation and the quantity of the advance and a box that you must tick since it represents the acceptance of these General Contract Terms and the Privacy Policy.

  7. To finish the process, you must click on the confirm reservation button.

Your personal data will be requested to make the reservation and also the characteristics of the reservation and the dates. You will receive an email with the reservation information and these conditions.


In any case, once the contracting procedure has been completed, the provider’s contracting platform will inform the user by email of all the characteristics, price, contracting date, and dates of reservation.


If there is any type of error in the address given or in any other aspect of the order, you must notify us of this immediately using the email address that will appear on the website in order to rectify the error.

PRESTIGE HOTELS will provide customer service for FREE through our contact email, prestigewelcome@prestigehotels.com. If you choose an alternative means of communication, you will be responsible for its cost. 


PRESTIGE HOTELS provides telephone numbers in Spain subject to the cost charged by your telephone operator.


MEMBER OF CLUB PRESTIGE


The user can register as Prestige user. When the user is client of the Prestige Club he has:


-        always a 10% discount associated with the rate of your reservation.


-        with each reservation make, you will accumulate points that you can transform into discounts for your next stays at Prestige Hotels. In order to apply the points and make the corresponding discount the reservation must be for a minimum amount of 100€.


-        each point is equal to a 1€ discount, under the indicated conditions.


-        each euro spent will have a bonus of 0.02 points.


 


5. RESERVE CONFIRMATION 


The PROVIDER will reserve the room under the payment conditions.


At the time of finalize the online, telephone or email reservation we will send you an email to the email address that you provided us when you make the reservation and the payment conditions and the reserve data.


If there’s any error in the data, you should contact immediately with our Customer Service at 972.252.100 or send an email to prestigewelcome@prestigehotels.com. In order to make the appropriate rectification.


 


6. PRICES AND OFFER VALIDITY PERIODS:


All prices displayed in the store www.prestigehotels.com include the VAT in force at the time of reservation. All prices shown on the website are valid and will be expressed in the euro currency (€). These prices, unless expressly stated otherwise, do not include the costs of cancellation, nor tourism tax and/or travel insurance.


The user will receive the invoice in reception when the stay finalises.


The prices applicable to each reservation will be those published on the website and applied automatically in the last phase of the purchasing procedure. 


In cases of promotions with a limited duration, the promotion discount will be applied as long as the reservation has been registered during the promotional period. 


The data recorded by the different payment methods constitutes proof of the date on which the financial transactions were made and will be used to determine whether or not said reservation is subject to promotion or not.


For any information about their reservation, the user may contact the provider’s customer service department through the phone number or email address provided.


 


7. PAYMENT METHODS:


When the user realizes the online reservation, we will ask the credit card data as a guarantee of the payment.


The user can pay at the hotel using:


-        Credit card: The user must have a valid credit or debit card and must specify all the digits of the card number on the corresponding form. The transaction is formalised at the time of placing the reservation. Only payments with secure cards are accepted where your identity as the cardholder is authenticated according to the method established by your bank, through secure e-commerce (“Verified by Visa” and “Mastercard SecureCode”). The order cannot be accounted for and will not be processed until the payment has been authorised by your bank or financial institution. 


The system known as SSL (Secure Sockets Layer) is used, which is a payment system in a secure environment, because it allows encryption of the information transmitted during the transaction, ensuring its confidentiality.


-        Payment in cash with the maximum of 1000€


-        Vacation check: company benefit to the worker.


 


8. CANCELATION CONDITIONS AND PAYMENT:


The right of withdrawal shall not apply to contracts concerning to the supply of accommodation services for other purpose than became a home if the contracts provide a specific date or period execution.


The cancellation of reservation in case of non-group reservations:


-        In the period from 1/07 to 11/09, both inclusive:



  • If you cancel before there are 5 days left for the start of your reservation, no charge will be made.

  • If you cancel during the 5 days before the arrival, you will be charges 100% of the reservation.


-        High season (Spring break from 9/04 to 12/04 both included San Juan 23/06/ Summer from 7/07/2022 to 11/09/2022 both included)



  • Before 10 days of arrival no charge will be made.

  • From 10 days to 24 hours before the arrival a 40% penalty will be charged.

  • Less than 24 hours before the arrival, 100% of the reservation will be charged.


-        In the rest of the year



  • If you cancel before 48 hours from the start of the reservation, no charge will be made.

  • If you cancel between 48 hours and the day of the reservation, you will be charged 100% of the reservation.


For reservations with non-refundable rates no amount will be refunded.


Cancellations, if you are registered, can be requests through your account and if you are not registered, in email to prestigewelcome@prestigehotels.com


If the reserved accommodation is not occupied on the day of arrival or at the latest on the following day before 12h, the reservation will be automatically cancelled, unless we have been notified in writing of the delay.


In case of delay on the day of arrival or early departure in any modality, 100% will be charged unless there is an agreement between both parties.


 


9. STAY CONDITIONS:


Arrivals: the accommodation can be occupied the day of the arrival from 14h.


At the arrival and following the current legislation, the USER must give the paper of reservation and identify all the occupies of the accommodation.


The tourism tax will be apply following the current legislation and in the reception at the moment of arrival.


Exit: the accommodation must be free the day of the departure at 12h.


Responsibilities of the client:


The user is involved to follow the Hotel normative. During the rest hours from 10.00 to 20.00, isn’t allowed to use the rooms for party celebration or make noise. In no case it’s allowed to occupy the room by more people than those established in the maximum capacity.


It’s forbidden to hang towels and clothes on the balcony railings.


The pools hours are set by each Hotel and in general is 9.00 to 20.00. It is forbidden to nail objects like parasols, awning, etc. on the grass as well as using lilo in the pool.


Children must always be with their parents and under their responsibility.


The USER is responsible for the correct conduct of all his reservation partners, otherwise, the PROVIDER reserves the right to expel the occupants of the accommodation without the right to future claims or any type of compensation. 


PRESTIGE HOTELS won’t be responsible for any direct or indirect damage that may be caused because of misuse of the room, including without limitation: damage, loss after fire, delinquency, accidents or other types of damages.


Animals are only accepted at the Mar y Sol and Victoria hotels.


The provider won’t be responsible for reservation errors attributable to the user or caused by unavoidable and extraordinary circumstances.


Minors:  


-        Babies 0-1 years, have free accommodation.


-        Kids 2-12 years:

14/04/22 - 17/04/22, 23/06/22 - 25/06/22, 01/07/22 - 10/07/22 and 28/08/22. 10/09/22 with 50% discount.


11/07/22 - 27/08/22 with 40% discount.



  • 1st and 2nd kid with 1 adult: 50% discount.


Hotel Prestige MarySol



  • 1st kid sharing room with 2 adults: 100% discount. (Free).


Except:



  • 14/04/22 - 17/04/22, 23/06/22 - 25/06/22, 01/07/22 - 10/07/22 and 28/08/22. 10/09/22 with 50% discount.

  • 11/07/22 - 27/08/22 with 40% discount.

  • 2nd kid with 2 adults: 50% discount.

Hotel Prestige Goya Park



  • 1st kid sharing room with 2 adults: 100% discount. (Free).

  • 2nd kid sharing room with 2 adults: 50% discount. (Free)

  • 1st and 2nd kid with 1 adult: 50% discount.


-        Adults: for 13 years



  • 3rd and/or 4th people sharing room with 2 adults: 20% discount.


 


11. NULLITY AND INEFFECTIVENESS OF THE CLAUSES:


Should any clause of these General Terms and Conditions be declared fully or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part thereof to the extent that it is null or ineffective. The General Terms and Conditions will remain in force in all other respects and the aforementioned provision or the affected part thereof will be considered to have been omitted.


 


12. ONLINE DISPUTE RESOLUTION:


In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the user and the provider, without the need to resort to the courts of law, through the intervention of a third party, called the dispute resolution body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement and may eventually suggest and/or impose a solution for the dispute. 13. APPLICABLE LAW AND JURISDICTION:


These conditions will be governed by or interpreted in accordance with Spanish law unless expressly established otherwise. The provider and the user agree to submit any dispute that may arise from the provision of the services subject to these General Terms and Conditions to the courts and tribunals of the provider’s registered office (if not considered a consumer for the purposes of the Consolidated Text of the General Law on the Defence of Consumers & Users (TRLGDCU)) or of the user (if considered a consumer for the purposes of the TRLGDCU). 


 


14. APPLICABLE LEGISLATION:


These General Terms and Conditions are subject to the provisions of: 


European regulations governing e-commerce:



  • Directive 97/7/EC on the protection of consumers in respect of distance contracts (Distance Selling Directive); and

  • Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce).
